Reclamación de más de 140.000 euros por cierre del centro Norai en noviembre de 2021

The Consell Consultiu has estimated a claim from the Amés Foundation, which is seeking more than 140,000 euros from the Mallorcan Institute of Social Affairs (IMAS) for the damages caused by the revocation of the agreement and the ordered closure in November 2021 of the Norai center, located in Son Roca (Palma), due to the security and coexistence problems that arose with the migrant minors accommodated there.

In the opinion, the Consultiu, although not assessing the specific measures taken or the unilateral revocation, nor the revocation of the authorization, does estimate the pecuniary liability specified at 143,643 euros, based on the reports of an audit.

«The Administration can change protection measures and execution instructions. However, it cannot overlook the damages caused by such decisions and cannot demand from the center in one month what it has not demanded during the execution of the agreement nor has posed any impediment to accreditation, even more so, for the emergency hiring of six more places, which, certainly, should not contribute to the proper functioning of the establishment due to their own characteristics,» states the report accessed by Europa Press.

The consultative body refers in this way to the disagreement that arose between the IMAS and the foundation due to the security and coexistence problems with the minors accommodated there, whose number increased that summer after several waves of small boats arrived on the shores of the Balearic Islands, which led in August to an extension of the places commissioned and added to the agreement signed in March of that year.

In its claim, the foundation explains that some of the minors accommodated exhibited disruptive behaviors that disrupted the peaceful coexistence of the center. It mentions the impact on other users, insults to educators, non-compliance with rules and conditions, and refusal to follow professional guidance. Also, according to the claimant, they did not provide truthful information about personal, family, or economic circumstances.

This situation was transferred to the IMAS, which, in the opinion of the entity, merely blamed the center for the insecurity generated and even went so far as to demand the installation of bars.

The conflict culminated in the termination of the contract in November 2021, alleging, on the part of the IMAS, that the foundation had not fulfilled its obligations regarding security regulations, the closure of the center, and the transfer of minors to another location.

The initially claimed compensation amounted to 348,000 euros for salary costs, security measures taken, and invoices that the IMAS failed to pay until the end of the contract, scheduled for March 2022.
