The Santa Eulària Town Hall has imposed a financial penalty of over 580,000 euros on the individuals responsible for a property that was being illegally marketed as a tourist rental.
The fine is directed towards Craft Capital Ibiza S.L. and its owners for allegedly carrying out an illegal change of use in a property located in the town of Jesús. This property, originally designated for residential use, was being advertised as tourist accommodation without the necessary authorization, contravening the current urban planning regulations in the Balearic Islands.
This violation incurs a fine of 32.50% of the affected building’s value, amounting to a financial penalty of 580,885 euros in this particular case. The Local Government Board has decided to propose the imposition of this fine in line with the regional urban planning and tourism laws, aiming to reinforce the regulations that ensure proper land use and compliance with the requirements for tourist activities.
The Town Hall has stated that this penalty was made possible through collaboration with the Ibiza Council and the cooperation protocol signed last year to combat illegal tourist rentals. In this instance, the Tourism inspection services of the island institution identified that the property did not meet the legal requirements for commercializing it as tourist accommodation and reported this to the Town Hall.
As a result, the corresponding sanctioning procedure was initiated for the change of use from residential to tourist. The initiation of the procedure was notified in March 2025, and no objections were raised by the responsible parties. Additionally, in an effort to address this issue, Santa Eulària has engaged the services of private investigators to gather information and evidence on tourist apartments within the municipal area.
These investigators will undertake various actions to obtain information that can demonstrate the presence of illegal tourist activities. This service, funded through the proceeds of the Sustainable Tourism Tax (ITS), serves as an additional tool to strengthen the fight against unauthorized practices. This measure complements the existing initiatives of the Town Hall, including the establishment of a reporting section on the Línea Verde platform for citizens to report potentially illegal activities related to tourist accommodations.
Furthermore, the Local Police unit dedicated to pursuing cases of illegal tourist rentals, comprising two active agents, is another resource available to address this issue.
